Privacy Policy

1. Introduction
This Privacy Policy explains how TCDesk.ai ("TCDesk," "we," "us," or "our") collects, uses, and protects information when you use TCDesk.ai (the "Service"). TCDesk is a software tool that helps licensed real estate professionals coordinate transactions. By using the Service you agree to this Policy. If you do not agree, do not use the Service.
2. Information we collect
We collect: (a) Account information you provide when you sign up — your name, email address, password, mobile phone number, real estate license number, and the MLS system you use; (b) Transaction content you submit — contract documents, party names and contact details, dates, and related materials you upload or enter; (c) Communications — emails and text messages you send or receive through the Service, and their delivery records; and (d) Usage and device data — log data such as IP address, browser type, and actions taken in the app, used to operate and secure the Service.
3. How we use information
We use information to: provide, operate, and maintain the Service; perform the AI-assisted analysis you request (summaries, deadlines, and document review); send the communications you direct us to send; send you account, transaction, and service notifications by email and — only if you opt in — by text message; provide customer support; secure the Service and prevent fraud or abuse; and comply with legal obligations. We do not use your transaction content or contact information to serve advertising.
4. Text messaging (SMS)
If you provide your mobile number and opt in, we use it to send you transaction-coordination text messages (deadline reminders, document alerts, settlement reminders, status updates, and replies to messages you initiate). Consent to receive texts is optional and is never a condition of using the Service. We do not share or sell your mobile phone number, your SMS opt-in, or your consent information with any third parties or affiliates for their own marketing purposes, and no mobile information is shared with third parties for marketing. Message frequency varies; message and data rates may apply. You can opt out at any time by replying STOP, or get help by replying HELP. We keep a record of your opt-in as required to operate the program and to comply with law.
5. How we share information
We do not sell your personal information, and we do not share it with third parties for their own marketing. We share information only as needed to run the Service: (a) Service providers / subprocessors that process data on our behalf and under contract — for example, our cloud database and storage provider, our email-delivery provider, our text-messaging provider, and our AI provider — solely to deliver the features you use; (b) At your direction — for example, when you instruct TCDesk to email a document to a contact you specify; (c) Legal and safety — when required by law, subpoena, or to protect the rights, safety, or property of TCDesk, our users, or the public; and (d) Business transfers — in connection with a merger, acquisition, or sale of assets, subject to this Policy.
6. Data retention
We retain information for as long as your account is active and as needed to provide the Service, then for the period required to comply with our legal obligations, resolve disputes, and enforce our agreements. You may request deletion of your account and associated data as described below; some records (such as communication logs and consent records) may be retained where required by law.
7. Security
We use administrative, technical, and organizational safeguards designed to protect your information, including encryption in transit, access controls, and private storage for uploaded documents. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
8. Your choices and rights
You can review and update your account information in the app, opt out of marketing email where applicable, and opt out of text messages at any time by replying STOP. Depending on your jurisdiction, you may have rights to access, correct, delete, or port your personal information, or to object to certain processing. To exercise these rights or request account deletion, email support@tcdesk.ai; we will respond as required by applicable law.
9. Third-party links and content
The Service may contain links to third-party sites or reference third-party documents. We are not responsible for the privacy practices of those third parties, and this Policy does not apply to them.
10. Children's privacy
The Service is intended for licensed real estate professionals and is not directed to children. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us information, contact us and we will delete it.
11. United States
The Service is operated in and intended for users in the United States. If you access the Service from outside the United States, you understand that your information will be processed in the United States.
12. Changes to this Policy
We may update this Policy from time to time. Material changes will be reflected by updating the effective date above and, where appropriate, by additional notice. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Policy.
